Grieving Dad Shares Pics Of Wife And Unborn Child Killed By Drunk Driver To Petition For Stricter Laws

29-year-old Krystil Kincaid, who was eight months pregnant, was killed along with her child after a drunk driver smashed into her car and rather than helping her, live-streamed the damage to his car on Facebook.

It only takes a minute to change life as we know it. Zach Kincaid's world changed for the worse a year ago, when a drunk driver crashed into the car his pregnant wife was traveling in. When cops arrived at the scene, they found the 29-year-old Krystil, who was eight-months pregnant at the time, trapped inside her "partially on fire" Chrysler minivan. They were quick to extinguish the fire and take Krystil out of the wrecked car. They then airlifted her to a nearby hospital, where she was put on life support, but sadly, both mother and child were pronounced dead the following day.

Kincaid, who is completely devastated by the loss of his wife and unborn child is now determined to see justice served by pushing for stricter drunk-driving penalties. The father-of-four laid Krystil and their unborn daughter to rest on September 26 last year and took to Facebook to share heartbreaking pictures from the service held at the McWane Family Funeral Home.



 

 Posting the heartbreaking images to the social media platform, he wrote: A drunk driver speeding down a two-lane highway at 85+mph in the wrong lane around a blind corner destroyed my family. The max sentence for killing my wife and daughter is 10 years max. The state of California doesn't think there was intent, but I know driving recklessly in that manner, he didn't intend anything good... my daughter's due date was October 9th, a 36 week old fully developed baby isn't considered a person in the state of California.

He continued: How do I explain to my children this injustice. My children and I have never felt so disposable... Look at the devastation left behind that is my family and tell me it isn't time for a change... imagine if this was your family... Who will fight with me for change? Who will spread this like wildfire? Who will write their representatives and demand change?? We cannot as a society look the other way any longer. Driving drunk is intent.

Speaking to KESQ-TV, Kincaid revealed that he was on speakerphone with his wife when she met with the accident.  "I heard her scream and then I heard her voice quiver right before I heard the loudest crash I've ever heard in my life. Smashing metal, and it sounded like the car was tumbling -- and then all of a sudden it was just silence," he said. Kincaid listened through the phone for an agonizing 45 minutes as firefighters tried to get Krystil out of the burning vehicle. "(Crews were) trying to get her out and they couldn't get the door open they couldn't do anything. The fire was engulfing the car."



 

According to Daily Mail, when the officials found the drunk driver, Marcos A. Forestal, he was walking near his wrecked car live-streaming the crash on Facebook. The video has been deleted since, but the former professional boxer who sustained only minor injuries, shows the condition of his wrecked car, saying, "I had an accident. Guys, look at what happened to me. Man, a car crossed in front of me. Look at my car guys." 



 

As per a PEOPLE report, the Helmet Police Department revealed that "Forestal displayed symptoms of alcohol intoxication and was arrested." He was sentenced to 10 years in state prison in June this year after he pleaded guilty to gross vehicular manslaughter in March. He'd previously pleaded not guilty. Taking to Facebook after Forestal's sentencing, Kincaid — who is the father of 2 sons and 2 daughters — wrote: Yesterday during the sentencing the judge read Marco Forestal's statements to the probation interview.



 

Marco claimed my wife hit him, he claimed he couldn't help my wife because he didn't see her vehicle, or call 911 for help because his battery was at 3%. He also claimed he only had 2 drinks of bailey's 15 minutes before the crash... The fact he chose to Facebook live himself where he can see the video on selfie mode and you can clearly see my wife's car on fire in the background makes his statements of not seeing her car and his low battery claims even more of an insult to my family and our society. The fact he was intoxicated over double the legal limit at the time of the crash also burned inside of my body.



 

He added: This scum bag will sit around feeling sorry for himself, and never will take responsibility. The fact he will only spend 5 years behind bars and he took my wife's and daughters lives, and ruined mine and my surviving children's lives is beyond frustrating and soul breaking. This will continue to happen to people if the lawmakers in California keep pandering to alcohol companies and DUI defense lawyer lobbyists. It's disgusting the lawmakers care more about their kickbacks and perks than the lives and safety of the people in our community. Demand change before your family is next... 



 

A change.org petition set up by the grieving husband hopes to force the state's representatives to rethink drunk-driving penalties. The petition which has raised almost 193 signatures, reads: Ten years would not be enough to bring justice to this family when the man walked away from this crash uninjured, he posted video on Facebook live after the accident where he blamed Krystil, and never once did he go to check on her or see if he could help her. Why should the system not have a reasonable opportunity to charge this man with a sentence that would bring this family some justice since they no longer have their wife, mother, daughter, and friend
